Donald Cal pleaded guilty to violating two counts under The Occupational Health and Safety Regulations, 1996 in Melfort Provincial Court on November 30, 2020.
The two violations included:
- contravening subsection 8(1) of the regulations (being an employer or contactor, fail to give notice to the division as soon as reasonably possible of an accident at a place of employment that required a worker to be admitted to a hospital as an in-patient for a period of 72 hours or more); and
- contravening clause 12(c) of the regulations (being an employer, fail to comply with the duties of an employer at a place of employment including the provision of any information, instruction, training and supervision that is necessary to protect the health and safety of workers at work, resulting in the serious injury of a worker).
Cal was fined $10,000, along with a surcharge of $4,000, for a total amount of $14,000. Two additional charges were withdrawn.
The charges resulted from a worksite incident that occurred on October 25, 2018, near Hudson Bay, Saskatchewan. A worker fell from a house roof, causing them to become injured.
