Regina Supervisor and Company Prosecuted Under OHS Legislation

On January 21, 2015, Clark Roofing Regina Ltd. pleaded guilty in Regina Provincial Court to two counts under Occupational Health and Safety legislation.  The company was fined a total of $7,000. 

Clark Roofing Regina Ltd. pleaded guilty for contravening: 
• section 116 of the regulations for failing to ensure that workers use a fall protection system at a work area where a worker may fall three metres or more and did thereby cause a serious injury to a worker; and 
• section 17 of the regulations for failing to ensure that all work at a place of employment was sufficiently and competently supervised. 

Three other charges were stayed.  In addition, Harold Vincent, supervisor at Clark Roofing Regina Ltd., was also charged and pleaded guilty for contravening subsection 17(2) of the regulations for failing to ensure that the workers under his direction comply with the Act and regulations and did thereby cause a serious injury to a worker.  He was fined a total of $2,100. 

Charges were laid after an incident that occurred on July 12, 2012.  An employee was seriously injured after he went onto a roof to move a hoist.  The employee’s leg was caught in the hoist as it was being lowered over the edge of the roof and the employee fell two stories to the ground.
