Pilot Butte Employer Fined for OHS Violations

On October 29, 2014, Michael Macala, operating as TM Excavating, pleaded guilty in Regina Provincial Court to two charges relating to a failure to comply with occupational health and safety legislation pertaining to protective headwear and safe trenching.  The Court imposed a fine of $1,150 with a $345 surcharge.

Charges were laid after a May 3, 2012, worksite inspection revealed non-compliance with The Occupational Health and Safety Act, 1993.  Michael Macala pleaded guilty to two charges:
  • for contravening clause 260(1)(c) of the regulations for the failure to ensure that equipment and spoil piles are kept at least one metre from the edge of an excavation or trench ($1,000 fine with a $300 surcharge); and
  • for contravening section 91 of the regulations for failing to ensure that workers wear approved industrial protective headwear ($150 fine with a $45 surcharge).
One charge was stayed.
