Courts Impose More Than $14,000 in Fines for Worker Injury and Safety Violations

Cosmopolitan Industries Ltd. of Saskatoon pleaded guilty to one count under occupational health and safety legislation and was fined $14,000 in Saskatoon Provincial Court on April 28, 2014.

The company pleaded guilty to:
  • contravening section 139 of the regulations (failure to ensure that before a worker undertakes the maintenance of a machine that the machine is locked out and remains locked out during that activity if not doing so would put the worker at risk and did thereby cause a serious injury to a worker) and was fined $10,000 with a $4,000 surcharge.
 The company was charged after a serious injury occurred in Saskatoon on January 5, 2012.  A worker was performing maintenance on a trash conveyor and fell nine feet to the ground.  One additional charge was stayed.

In a separate matter, Darren McKenzie of Regina pleaded guilty to one count under occupational health and safety legislation and was fined $360 in Regina Provincial Court on April 24, 2014.

Mr. McKenzie pleaded guilty to:
  • contravening clause 116(2)(a) of the regulations (failure to comply with The Occupational Health and Safety Act, 1993, and its associated regulations, by failing to use a fall protection system at a work area where he could have fallen three metres or more) and was fined $300 with a $60 surcharge.
 The conviction relates to an incident in Regina which occurred on April 28, 2011.  An Occupational Health Officer observed three workers working on a roof of a building in violation of occupational health and safety legislation. 

In the first month of 2014-15, there have been 17 convictions for occupational health and safety violations with total fines of nearly $45,000.
