Saskatoon Roofing Company Pleads Guilty to Safety Violations

Shaun Fiolleau, operating as Fiolleau Roofing Company of Saskatoon, pleaded guilty to two charges under occupational health and safety legislation and was fined $3,850 in Saskatoon Provincial Court on January 13, 2013.

Fiolleau pleaded guilty to:

  • contravening clause 17(1)(a) of the regulations (failure to ensure that all work at a place of employment was sufficiently and competently supervised) and was fined $750 with a $300 surcharge; and
  • contravening clause 116(2)(a) of the regulations (failure to ensure that a worker used a fall protection system at a work area where the worker may fall three metres or more) and was fined $2,000 with an $800 surcharge.

Two additional charges were stayed.

The charges stemmed from a worker injury that occurred on December 23, 2010.  A worker employed by Shaun Fiolleau was injured when he fell from a roof onto an air compressor.  The worker was not wearing fall protection.

Fiolleau had been contracted by McDiarmid Lumber Ltd. of Saskatoon.  McDiarmid Lumber Ltd. pleaded guilty to one charge under occupational health and safety legislation for failing to ensure that a worksite that was not under the direct or complete control of the employer was safe for workers.  The company was previously fined $2,800 in Saskatoon Provincial Court. 

In the last five years, OHS has cited 6,389 contraventions in the construction sector.
