Individual Fined More Than $5,000 for Safety Violations

Nick Tuchscherer of Weyburn, has pleaded guilty to two charges under occupational health and safety legislation and was fined $5,380 in Weyburn Provincial Court on December 10, 2013.

Tuchscherer pleaded guilty to:
  • contravening section 263 of the regulations (failure to ensure that a worker in a trench that was more than 1.2 metres deep was protected from cave-in or sliding material) and was fined $3,500 with a $1,400 surcharge; and
  • contravening section 154 of the regulations (failure to ensure that only trained operators were permitted to operate powered mobile equipment) and was fined $400 with an $80 surcharge.
The conviction relates to an incident which occurred on October 17, 2011.  An Occupational Health Officer observed a back-hoe digging a trench that was not protected against cave-ins.  The trench measured more than two metres deep and the walls were not cut-back at a 45 degree angle.  Two other charges were stayed.

Occupational Health and Safety (OHS) conducts approximately 4,000 worksite inspections annually to ensure standards are known, understood and enforced.  In the last five years, OHS has cited 6,389 contraventions in the construction sector.
