Two Companies Fined for OHS Violations

Released on December 19, 2014

Fred Thue Construction Ltd. of Lumsden pleaded guilty to two counts under Occupational Health and Safety (OHS) legislation and was fined $16,800 in Regina Provincial Court on December 1, 2014.

Fred Thue Construction Ltd. pleaded guilty for:
  • Contravening section 8 of The Occupational Health and Safety Regulations, 1996 for failing to notify the Occupational Health and Safety Division as soon as reasonably possible of an accident causing serious bodily injury to a worker ($2,000 fine with a $800 surcharge); and
  • Contravening clause 116(2)(a) of The Occupational Health and Safety Regulations, 1996 for failing to ensure that a worker used a fall protection system at a work area where a worker may fall three metres or more ($10,000 fine with a $4,000 surcharge).
Three other charges were stayed.

Charges stemmed from a matter that occurred on August 18, 2009, where a worker of the company fell approximately 6.5 metres from a roof truss onto the ground sustaining serious injuries.  The incident occurred at a farm site in the R.M. of South Qu’Appelle.

In another case, Elite Trenching of Regina pleaded guilty to one count under Occupational Health and Safety legislation and was fined $2,100 in Regina Provincial Court on December 4, 2014.

Elite Trenching pleaded guilty for contravening section 263 of The Occupational Health and Safety Regulations, 1996 for failing to ensure that a worker present in a trench more than 1.2 metres deep is protected from cave-ins or sliding material.  The company was fined $1,500 with a $600 surcharge.  Three other charges were stayed.

The Ministry of Labour Relation and Workplace Safety recommends prosecutions where individuals or companies refuse to comply with the provisions of legislation or where significant risk or injury to workers is present as a result of non-compliance.  Since April 1, 2014, there have been 46 convictions for occupational health and safety violations with total fines of $529,865.
