Graham Construction and Engineering Inc. of Saskatoon pleaded guilty to one count under occupational health and safety legislation and was fined $3,500 in Saskatoon Provincial Court on March 24, 2014.
The company pleaded guilty to:
- contravening clause 17(1)(a) of the regulations (failure to ensure that all work at a place of employment was sufficiently and competently supervised) and was fined $2,500 with a $1,000 surcharge.
The charge relates to an inspection on October 20, 2010, where an Occupational Health and Safety (OHS) Officer noticed a portion of a trench had collapsed at a Saskatoon construction site. One additional charge was stayed.
In a separate matter, Jesse Manulak, operating as Masterworks Roofing, of Regina pleaded guilty to two counts under occupational health and safety legislation and was fined $1,040 in Regina Provincial Court on March 24, 2014.
Jesse Manulak pleaded guilty to:
- contravening section 116 of the regulations (failure to ensure use of a fall protection system at a temporary or permanent work area where a worker may fall three metres or more) and was fined $600 with a $240 surcharge; and
- contravening section 96 of the regulations (failure to use footwear that is appropriate to the risks associated with the worker’s place of employment and occupation) and was fined $150 with a $50 surcharge.
The charges were laid after an inspection on June 21, 2012, where an OHS Officer observed workers on a roof without utilizing fall protection equipment and appropriate footwear. One additional charge was stayed.
In another case, Innovation Renovation Inc. of Regina pleaded guilty to two counts under occupational health and safety legislation and was fined $1,090 in Regina Provincial Court on March 26, 2014.
The company pleaded guilty to:
- contravening section 116 of the regulations (failure to ensure that a worker at a work area use a fall protection system where a worker may fall three metres or more) and was fined $600 with a $240 surcharge; and
- contravening section 91 of the regulations (failure to require a worker to use approved industrial protective headwear) and was fined $200 with a $50 surcharge.
The charges relate to an inspection on September 28, 2012, where an OHS Officer observed three workers at a Regina residential construction site working in violation of occupational health and safety legislation. Three additional charges were stayed.
These three cases represent the final prosecution convictions for 2013-14. There have been 85 convictions for occupational health and safety violations with total fines of nearly $650,000.
