Retrospective Facility Licence Liability Adjustment

Overview

Initially, facilities were not licensed in Saskatchewan. The Retrospective Facility Licensing Program was implemented to license facilities that existed or were under construction prior to June 19, 2007.

In some instances, a retrospective facility licence may have been issued in cases where the facility was never physically constructed.

Guidance

A licensee with a retrospective facility that was never physically constructed can apply to the ministry to request the facility licence be considered for liability adjustment, under the LLR Program, and/or possible cancellation.

Eligibility

Before submitting a Retrospective Facility Licence Liability Adjustment application, you must:

  • Have an Integrated Resource Information System (IRIS) account and the appropriate permissions assigned by your IRIS Security Administrator.
  • Be the registered licensee of the facility licence in IRIS.
  • Obtain your Licensee Liability Inventory Report and ensure the facility licence appears with the following:
    • Licence status is other than “Proposed”
    • The Retro Licence column is “Yes”
    • The Annual Volume column is “No” (unless the facility type is "Injection/Production Satellite")

How to Apply

To apply for a retrospective facility licence application, the licensee must:

  1. Ensure the eligibility criteria are met.
  2. Complete the Retrospective Facility Licence Liability Adjustment Form.
  3. Prepare a signed letter agreeing to cancellation of the licence (if warranted).
  4. Submit the completed form and signed letter (as PDF documents with no security applied) to the ER.ServiceDesk@gov.sk.ca with subject line "Attn: Liability Regulations - Retrospective Facility Licence Liability Adjustment Request.

Licensees will be contacted via email after the request has been reviewed. Please note that submitting the request does not guarantee that the facility licence will be adjusted or cancelled.

On approval, the liability associated with the licence would be adjusted in IRIS, where applicable, and reflected in the Licensee Liability Inventory report (available in IRIS).
